Slovakia sent formal Commission request

Slovakia has been sent a formal request by the European Commission to review a recent services contract award.

The request was made in regard to the award by the Slovak Ministry of Transport of a legal services contract in the context of a motorway construction project in 2007. In the Commission’s view, the contract was awarded without a sufficient level of advertising as required under EU public procurement rules. The Commission also considers that the Slovak Ministry of Transport violated its transparency obligations, stemming from the general principles of the EC Treaty.

This formal request takes the form of a Reasoned Opinion, which is the second stage of the infringement procedure laid down in Article 226 of the EC Treaty. If there is no satisfactory reply within two months, the Commission may refer the matter to the European Court of Justice.
