Commission requests Spain to comply with Court judgment

Spain has been requested by the European Commission to comply with a 2008 judgment of the European Court of Justice.

The Commission has decided that under Article 228 of the EC Treaty, Spain should comply with the ECJ’s judgment in case C-444/06, in which the Court ruled that Spain had failed to fulfil its obligations under the EC Public Procurement Remedies Directive 89/665/EC by not providing for a mandatory standstill period in a former contract award.

If there is no satisfactory reply from Spain, the Commission could refer the matter to the ECJ.
