Like many areas of the new UK Public Contracts Regulations 2015, the criteria listed for use in the selection stage in EU procurements have undergone significant enhancement.

Many of the selection questions we know so well remain, but they have been enhanced by a number of new requirements.

The Mandatory and Optional Exclusions have been augmented, but the rest of the Selection stage is also facing change.PASS New UK Public Contracts Regulations 2015

To enforce environmental and employment requirements, for example, there will be the ability for authorities to ask for evidence to support the supplier’s position. Suppliers may be asked to evidence that their supply chain or manufacturing base is free of child labour. This will require suppliers to audit their own supply chain to evidence their position in such matters.

Contracting authorities may also require contractors to prove they have a certain minimum yearly turnover, including a certain minimum turnover in the area covered by the contract, although in general this shouldn’t be more than twice the value of the contract itself.

Additionally, contracting authorities may require contractors to provide information on their annual accounts showing the ratios, for instance, between assets and liabilities.

The new Regulations also allow contracting authorities to impose requirements in respect of technical and professional ability, to ensure that contractors have the necessary human and technical resources and experience to perform the contract to an appropriate quality standard.

All in all, the selection stage is going to require buyers to rethink their process and suppliers to develop more evidence-based information.
